1. Acceptance
These terms are an agreement between you and BommieSurf. By creating an account or using the app you accept them. If you do not accept them, do not use the app.
We record which version of these terms you accepted and when. If we change them materially we will ask you to accept the new version before you continue.
2. The service
BommieSurf is a personalised surf forecast. You save the breaks you surf and describe the conditions that work at each one — tide, swell size, wind direction and strength — and we score every daylight hour of the forecast against that description.
The forecast is model output. It is not safety advice.
Every number in the app comes from a numerical weather and wave model predicting the future, and models are wrong regularly and sometimes badly. The wave model resolves to roughly eight kilometres, so it cannot see a sandbar, a rip, a reef, a rock, a current, a closeout, other people in the water, marine life, or the state you are in that morning. Tide heights are modelled and are relative to mean sea level, not chart datum; they are not for navigation.
Conditions at the coast change faster than any forecast updates. A score of 9 is not a statement that a break is safe, and a score of 1 is not a statement that it is dangerous.
You surf at your own risk. You are responsible for assessing the conditions in front of you, for knowing your own ability, and for deciding whether to enter the water. To the extent the law allows, we are not liable for any decision you make on the basis of anything shown in this app.
3. Eligibility
You must be at least 16 years old to hold an account. If you are under 16, do not sign up. If we learn that an account belongs to someone under 16 we will close it and delete its data.
4. Accounts and security
You need an account to use the app. Give us an email address you control — it is how you sign in, how you recover access, and how we reach you about the service.
Keep your password to yourself. You are responsible for activity under your account. Tell us promptly at hello@bommiesurf.com if you believe it has been used without your permission.
You may delete your account at any time from Settings. Section 6 of the Privacy Policy explains exactly what survives that deletion and why.
5. Plans, trials and billing
BommieSurf has a free trial, a free tier and a paid subscription (Pro). What each one includes is shown in the app and is read from our plans table at the moment you look at it, so it is always current. We may change what a plan includes; material reductions will be notified.
One trial per person. The trial is a single offer, not a renewable one. To enforce that we keep a record that a trial has been used, keyed to a one-way hash of your email address and, where the platform gives us one, a hash of your app-store account. That record survives deletion of your account. Deleting and signing up again will not start a second trial; you will begin on the free tier. The Privacy Policy sets out precisely what the record contains.
The free tier shows advertising. Pro does not.
We do not process payments. Pro is sold and billed by Apple through the App Store and by Google through Google Play. Their terms, their billing, their renewal rules and their refund policies apply, and a refund is requested from them and not from us. Cancelling stops the next renewal; it does not by itself refund the period you are in.
6. Acceptable use
You may use BommieSurf for your own surfing. You may not:
- scrape, crawl, bulk-download or systematically extract forecast data;
- resell, redistribute, sublicense or republish the forecast or the scores;
- access the service by automated means, or at a volume a person could not produce;
- reverse-engineer, decompile or attempt to derive the scoring model;
- create multiple accounts, or use false details, to obtain more than one trial or to get around a plan limit;
- interfere with the service, probe it for vulnerabilities, or use it to break the law.
7. Intellectual property and your licence
The app, its interface, its scoring model and the BommieSurf name and marks are ours or our licensors'. Nothing in these terms transfers them to you.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial surfing. That licence ends when your account does.
The spots and preferences you save are yours. You grant us the licence we need to store, process and display them in order to give you a forecast — nothing wider than that.
8. Third-party data and services
BommieSurf is built on services we do not control, each under its own terms:
- Open-Meteo — weather, wave and sea-level data.
- OpenStreetMap contributors — map tiles and place search.
- Supabase — database and authentication.
- Vercel — hosting.
- Apple and Google — subscription billing.
We pass their data through substantially as we receive it. We do not warrant their accuracy or availability, and an outage at any of them can take part or all of the service with it.
9. Availability and changes
We aim to keep BommieSurf running but do not promise uninterrupted service. We may change, suspend, or withdraw features, and we may impose or alter limits. We will give reasonable notice of material changes where we can.
10. Termination
You may stop using the app and delete your account at any time.
We may suspend or terminate an account that breaches these terms, that we reasonably believe is being used unlawfully, or where we are required to. Where it is reasonable to do so we will tell you why and give you a chance to put it right.
Sections 7, 11, 12, 13 and any accrued rights survive termination.
11. Disclaimer of warranties
To the fullest extent permitted by law, and subject to section 12, the app is provided "as is" and "as available" and we make no warranty that it will be accurate, complete, reliable, uninterrupted, secure, or fit for any particular purpose.
12. Limitation of liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded. If we are entitled to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to re-supplying the service or paying the cost of having it re-supplied.
Subject to that, to the fullest extent permitted by law:
- we are not liable for indirect, incidental, special, punitive or consequential loss, or for loss of profit, revenue, goodwill or data; and
- our total aggregate liability for all claims arising out of or relating to the app is limited to the greater of one hundred Australian dollars or the amount you paid us in the twelve months before the claim arose.
13. Governing law
These terms are governed by the law of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.
14. Changes to these terms
We may update these terms. The "Last updated" date at the top will change, and material changes will be notified in the app and will require your acceptance before you continue. Continuing to use the app after a non-material change means you accept it.
